Power of attorney, literally means the document, which gives right to a person to handle the entire business transactions and deals with the parties on behalf of another person, corporation or agent whereas DMV power of attorney is the document which legally gives right to an agent to conduct the main task related to vehicle with the buyer on behalf of the principal.
The vehicle transactions performed by an agent include buy, sell or registration of a vehicle. He used to record the liens for the principal and also apply for a duplicate title certificate of the vehicle to be purchased. But, the Department of Motor Vehicles does not have legal right to offer a power of attorney form.
Power of attorney is basically of two types – Specific and General. Specific power of attorney is that under which a specific transactions can be performed by the agent for his principal. He can do only the particular transactions mentioned in the power of attorney. But only a general power of attorney is acceptable in the DMV office. A general power of attorney is that document in which an agent can deal with lots of transactions on behalf of the principal.
DMV power of attorney in general type is only acceptable for transferring the vehicle title when the original title certificate is presented in front of DMV office by the applicant. Secondly, when both the person transferor and transferee are not one and the same person, then this general power of attorney is being accepted in DMV office. But, its use is barred for automobile dealer.
There are few basic requirements of DMV power of attorney and will only assumed to be acceptable only if it possess the all necessary requisites. The first thing the power of attorney must possess is the issue date; the name, address and signature of the principal and also the name and the address of the agent. Second most important feature of this attorney is the notification of the power of attorney. Then, it is the legal duty of the agent to mention P.A. just enclosed to the signatures done by him. To make the involvement of the agent in almost more than one matter the, it must be made clear to the DMV representatives beforehand only. So, he will pass over the power of attorney to the agent after the transaction is completed. However, if the power of attorney is of secure type, then the DMV representative will attach that power of attorney with the application presented by the agent on behalf of the principal.
