Dual Power Of Attorney

A power of attorney is defined as a document which enables you to appoint an organization or a person to take decisions on your behalf when you are unable to do so. The person appointed is known as attorney in fact or agent in United States. In dual power of attorney two persons are responsible for making decisions but they should fully agree on decisions. Single person cannot make decisions alone. Power of attorney is of following types.

  • General Power of Attorney
  • Special Power of Attorney
  • Health Care Power of Attorney
  • Durable power of attorney

In general power of attorney your agent is authorized to work on your behalf in different conditions. In special power of attorney he can only take decisions in particular situations only. When you are unable to make healthcare related decisions about yourself then you can appoint someone for health care power of attorney. Durable power of attorney can be made by addition of special text to health care power of attorney.

A dual power of attorney form is slightly different from other power of attorney forms. The decisions made by both the persons holding dual attorney are fully responsible for their decisions. If there is any type of fine imposed then this should have to pay by both. Any financial decision should be signed by both the persons. Generally siblings and spouse are appointed for dual power of attorney. You can also appoint some professional for making decision to save any type of breaching.

Dual Power Of Attorney

A general power of attorney is granted when you are travelling out of country or you are mentally or physically not able to make decisions. Special power of attorney is granted when you are unable to make decisions on some matters when you are not available due to other commitments. Here person can take decisions in only few situations for which he or she has been given power of attorney. Dual power of attorney is given in situations when you think consent of two persons are required for making decisions. You can also appoint successor agent for power of attorney. There may be some situations when the person you have appointed as agent in fact is unable to continue his services, then successor agent work as agent in fact.
